In these Terms & Conditions (“T&Cs”), “we”, “our”, “us” or “MELT” means MELT Pilates (ABN 36 686 873 129).
Services provided
Group Hot Mat Pilates & Yoga
Cancellation policy
Classes must be cancelled 4 hours prior to the start of the booked class to avoid the client forfeiting the class.
In the event the client cancels more than 4 hours before the start of class, the class will be credited back to their account.
In the event the client cancels within 4 hours of the class time, they will incur a $5 late cancellation fee.
Cancellations via email, phone or social media will not be accepted. The client must cancel their class the same way they made the booking, either via the Momence app or directly through the website www.melt-pilates.com.au.
MELT Pilates reserves the right to cancel classes if there are fewer than 3 people booked into the class. On the occasion the class is cancelled by Melt Pilates, the client will have the class credited back to their account.
In the event the client does not show to their booked class, a no-show fee of $10 will be charged to their nominated credit card.
Purchase Policy
Classes must be paid in advance of each class attended.
Payment is to be made at the time of booking.
Payment for classes can be made via Momence app and directly through the website www.melt-pilates.com.au.
Intro offer is available to new clients only. This offer may only be purchased once. The offer is non-refundable and non-transferable. This pass entitles you to unlimited group mat classes to be used within 14 days. The pass will activate on the date of your first class and expire after 14 consecutive days. It is available to new clients only and can only be purchased once.
All casual pass packs will activate from the date of your first class booked.
All casual pass packs have a 6-month expiry.
There will be no extensions granted on any casual pass packs unless a medical reason/condition arises. In this event, the client must provide medical documentation from a registered health practitioner.
Memberships
All memberships are direct debited weekly with a 3-month minimum contract term. Contract will automatically renew once the minimum three-month period has finished unless the client provides written notice to cancel after the initial term. Late cancellation and no-show fees apply.
Change to your contract price
After the initial minimum contract period, the contract with MELT Pilates will roll over automatically. In such cases, MELT Pilates reserves the right to adjust the contract price. Any changes to the contract price will be communicated with a minimum of two weeks' notice to the client.
Suspensions
You may temporarily hold your membership for a minimum of 2 weeks (14 days) at a time and up to a maximum of 4 weeks (28 days) per 3 month (12 week) contract. Holds, cancellations and changes to membership cannot be backdated. Please email hello@melt-pilates.com.au with at least 7 days notice and allow up to 48 hours for your request to be processed. Suspensions to your membership will only pause your contract term and the full minimum contract term of 12 weeks minimum will resume once the suspension to your membership has finished. Suspensions can only be placed 4 weeks into the membership start date.
Cancellations
Cancellation of memberships require a two week (14 days) notice period. You must provide written advice to hello@melt-pilates.com.au. Cancellation to memberships can only be requested once the minimum contract term has been fulfilled.
Returns/Refunds
There will be no extensions or refunds on any memberships, casual pass packs, intro packs or any services that we offer, unless a medical reason/condition arises. On this event, the client must provide medical documentation from a registered health practitioner.
Pregnant Clients
Melt Pilates unfortunately cannot accommodate pregnant clients in our heated mat room for your safety no matter what stage you are in your journey.
Waitlist
If a class is full, you can add yourself to the waitlist. If there are any cancellations, you will be notified up to five hour before the class commences.
When adding yourself to the waitlist, you are committing to attend that class should a space become available. Please remove yourself from the waitlist if you no longer wish to attend to avoid late cancellation or no show fees as these will still apply in this instance. There are often changes to class attendance even last minute ones, so if a place opens up for you, you will get an email or text depending on setting preferences. By not opting to receive text and email notifications does not excuse you from being charged a late cancellation or no show fee in case you miss the notification. Please contact us to update your preferences if you did not opt into receiving notifications.
Classes start and end on time
The studio doors are locked while classes are running and unfortunately there is no late entry (late arrivals are considered a no show and will be charged accordingly). We know that life sometimes doesn’t go to plan, and you may be running late but we’re not able to hold the class start time, or accept cancellations over the phone, on email or socials.
Personal agreement
I agree that MELT Pilates will not be held responsible for any lost or stolen personal belongings. I understand classes may be physically strenuous and that full care must be taken when receiving instructions and performing exercises.
I accept that there is potential risk of personal injury, property loss or death, and I agree that neither I, my heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against Melt Pilates or its members for any personal injury, property damage/loss, or wrongful death, whether caused my negligence or otherwise.
Medical warning
Prior to undertaking any new form of exercise, you should consult with your doctor or other healthcare practitioner to ensure that you are mindful of your current health and any restrictions that may be appropriate for you.
When participating in MELT Pilates classes, do not over exert yourself and work at your own pace. Stop immediately if you feel pain or discomfort. You should immediately seek medical attention if there are any unanticipated changes to your physical condition at any time.
You must notify your instructor if you have any pre-existing injuries or medical conditions which may impact upon your ability to perform the exercises in our classes.
By undertaking any of MELT Pilates classes you acknowledge that you do so at your own risk that the creators, producers & instructors will not be liable for any personal injury, loss or liability of whatsoever nature arising as a result of or in connection with, your undertaking of any such exercise program or following advice contained on our website or given by our instructors.
Conditions of entry:
MELT Pilates reserves the right to refuse entry to, or eject from our Studios, clients or others who are behaving in an anti-social, intoxicated, disorderly, aggressive, offensive or dangerous manner or in any manner which may threaten the security of our clients or other people at the Studio.
Clients are strongly discouraged from departing classes prior to their scheduled conclusion time as it is disruptive to the enjoyment of other students attending those classes.
Smoking is prohibited inside and out the front of our Studios at all times.
You are required to treat all persons and property at the Studios with all due care and respect.
Students are required to wear appropriate attire for physical exercise at all times while visiting our Studios, and must refrain from wearing clothing which contains offensive prints or designs or which may presents a danger to themselves.
For the enjoyment of all participants in your class please turn off all mobile phones before your workout.
Mobile phones must not be used in class.
Payment
It is the client’s responsibility to ensure there are sufficient funds available in your nominated bank account or credit card to cover the cost of purchasing any class packs or other products from us.
If a payment is declined for any reason, we reserve the right to process payment anytime where sufficient funds are available in the nominated bank account or credit card in order to settle any fees that are owed. If an auto-debit is declined due to insufficient funds our payment provider will charge for any failed transactions. This fee will be passed on to you approximately 7 days after the failed payment.
We are in no way responsible for additional fees that you may incur from your bank in relation to processing payment of fees.
Personal belongings
MELT Pilates are not responsible in any way for the safekeeping of your personal belongings that you bring into our studio. As such, we strongly recommend that you:
a. Refrain from bringing any valuable personal belongings into our Studio, such as mobile phones, jewellery, personal devices, wallets, bags and purses;
b. Bring only any personal belongings into our Studio which are necessary for you to possess for the duration of your visit; and
c. Store any personal belongings in the lockers provided for use at our Studio for the duration of your visit.
